So, my last post mentioned that my adjuster is having a hard time reaching the other parties adjuster. They are still playing phone tag. But now my concern is my downstairs neighbor who reported that my AC unit caused water damage to her unit has had the repairs made. Shouldn't they have waited to do the repairs, how are we supposed to see if my AC unit truly caused the damage? Shouldn't the adjusters agree on the repairs prior to them being done?

Help!

Yup, will be harder to prove now. But may not negatively impact you. It may just impact the downstairs neighbor or their insurer from recovering. Also, many of the subrogation laws will no longer allow subrogation against the responsible party. IE: If your AC unit malfunctioned, your insurer or her insurer might not be able to recover from the manufacturer of the AC unit or the installer of the AC unit because neither party or their insurers can inspect the damage or the parts.

Hello again,

So, in November my adjuster told me that the other side has closed the claim. Today I received a letter stating that the other insurance company has reopened the claim. I don't know how, after 3 months of being closed they can reopen the claim. Of course, my adjuster is on vacation. Any advice, can they do this?
