Cold Calling Against The Law ?

There's no "gamble"...the law is the law as written in the previous post:

Interstate commerce refers to the purchase, sale or exchange of commodities, transportation of people, money or goods, and navigation of waters between different states.

INTERSTATE COMMERCE

"Commerce between any place in a State and [not or] any place outside of that State, or within any possession of the United States (not including the Canal Zone) or the District of Columbia, and commerce between places within the same State but through any place outside of that State. 18 U.S.C.

If you are not doing INTERSTATE calling, you are good. If you want to play it safe, you can always pay the government the money and subscribe to the DNC list.

The only thing that gnaws at me is you can't call them and ask...they won't make a determination. I had to pay a lawyer to clarify the law.

3. What calls are covered?
The do not call provisions of the TSR cover any plan, program or campaign to sell goods or services through interstate phone calls. This includes calls by telemarketers who solicit consumers, often on behalf of third party sellers. It also includes sellers who are paid to provide, offer to provide, or arrange to provide goods or services to consumers.

The National Do Not Call Registry covers intrastate telemarketing calls under the FCC’s rules. You can find information on the FCC’s regulations at www.fcc.gov/cgb/donotcall/.

Pursuant to its authority under the Telephone Consumer Protection Act (TCPA), the FCC established, together with the Federal Trade Commission (FTC), a national Do-Not-Call Registry. The registry is nationwide in scope, applies to all telemarketers (with the exception of certain non-profit organizations), and covers both interstate and intrastate telemarketing calls. Commercial telemarketers are not allowed to call you if your number is on the registry, subject to certain exceptions. As a result, consumers can, if they choose, reduce the number of unwanted phone calls to their homes.
 
I do personally know an agent that go 2 $10,000 fines and his agency owner had to pay them. This was right after the law passed and maybe they were examples or something. But it did happen.

There is only one way that you can call everybody at any time you want and never worry about DNC...become a scum-sucking politician. They are exempt. Because of course we all want their important calls as we're eating dinner with our families.
