Compliant Return of MLR Rebates to Employees

The rules given out by the carrier are not clear enough for the employer to feel confident in making decisions.

How do they distribute them between those who had family coverage vs individual, etc. There isn't any guidance in the letters that go out other than the employer can reduce plan rates for next year, say, with a one time benefit holiday of the MLR distributed funds to each employee covered on the plan. We know they don't have to give a rebate to terminated employees, per the advice letter.

We aren't talking about much per employee on average if by numbers, not by individual vs EE/spouse/EE children/EE/family, etc.--maybe $40/50 for the group in question.
