Double Commission?

Just wanted to throw this out there since everyone is in an AEP mind set. Someone new to both Parts A & B and who has joined an MA would usually have the MA OEP available to them. Example Parts A & B started 8/1 and joined an MA 8/1. The OEP would be available until 10/31 to join a different MA or go back to Original Medicare and pick up a PDP.
 
Is this what you found? In order not to get the chargeback in this situation, the mb would have had to been enrolled in 1st MAPD for Oct, Nov or Dec effective and then chooses the 2nd MAPD for a Jan effective date. No chargeback would happen even for a new to Medicare Advantage situation, i.e., agent would keep the entire $482 and then get paid $255 for 2020 (as earned or lump sum depending on the carrier).
In the OP's situation, she would receive the entire $482 for 2019 since the 2nd plan would be for the Jan effective date and then $255 as earned or lump sum.

  1. 110.7.1 – Rapid Disenrollment

    42 CFR §§ 422.2274, 423.2274

    Rapid disenrollment applies when an enrollee makes any plan change (regardless of Parent Organization) within the first three (3) months of enrollment. Rapid disenrollment compensation recovery does not apply when a beneficiary enrolls effective October 1, November 1, or December 1 and subsequently uses the Annual Election Period to change plans for an effective date of January 1.
