One down. Supreme Court to go. Remember, they were unwilling to hear the case until the lower court ruled. Break out the popcorn people - this isn't gonna get real interesting.

See YAgents thread on this. I bet you the Supreme Court refuses to take it off the Appeals Court's docket. It doesn't take effect for 3 years. Let it go through the system and see if someone gets tired of pursuing it.

Ken Cuccinelli the VA Attorney General won't get tired pursuing it. It's made him one of the most popular politicians right now.
 
The federal gov imposes fines for not buying Part B and Part D. Is there any real difference here?

The fine is only if you later want to buy Part B or D. If you never buy either one, no fine. That is a MASSIVE difference from a fine you pay only if you don't buy health insurance.

To be a proper analogy, the fine for not having health insurance should be levied once you buy it, and continue for as long as you have it.

Apples and Oranges.

There are no fines. There are penalties WHEN you opt to buy Part B or Part D, and IF you opt to buy. Part B and D are optional.

What we have here is a fine for not buying something.

Let's say that the government decided that everyone would be forced to buy a burger. If you buy a burger and eat it, you have received a benefit. If you are fined for not buying a burger that you did not eat, there is no benefit.

Clearly unconstitutional and I'd give odds that the supreme court allows this just as they have allowed all the other crap that comes to them.

If this law is upheld by the Supreme Court - watch out. The government would get the green light to mandate that its citizens purchase products thereby not only directly controlling economic activity but deciding which companies receive the revenue.
