I'm guessing this moron judge was appointed by a Democratic president. Obviously he has not read the constitution.

In any event, doesn't really matter much at all. Nothing's final until the S. Ct. says it is, and that's a long way away.

More hope expected from one of two other major cases in federal court where the judges have shown inclination to limit, not expand, federal power. (those are the Virginia & Florida cases, respectively)

Don't lose any sleep over this one. It's meaningless, although an injunction issued would have been pretty dang funny.

Forcing people to buy health insurance is not such a bad thing from our point of view. Naturally, this Judge's decision will make those who choose not to buy insurance angry. This mandate is the one aspect of Obamacare that rouses the most negative emotion from the public...particularly the uninsured. Obama himself probably wouldn't have minded if the Judge decided that the mandatory-purchase clause was unconstitutional because its a big negative for him in the popularity polls.

yep, sure enough, the judge is a Clinton appointee per the NY Times

basically what he was saying is that NOT buying insurance DOES impact interstate commerce because it effectively drives up the cost of health insurance for everyone else, and thus, the Commerce Clause IS implicated.

humbug.

NOT buying groceries does not cause the price of groceries to go up for everyone else!
:1err:

I think the judge is saying that the medical profession and medical facilities charge more because they take financial losses on patients who don't have the ability to pay their bills. Since they charge insurance companies more, insurance companies have to charge their customers higher premiums than they would if every patient had health insurance.

With most products & services, his argument makes sense, but since we all want to get well, no matter what the cost, the medical industry will likely keep ramping up prices, even if every man/woman/child had health insurance.

This First Federal Judge has forgotten what they taught him in ecomomics-101 about price not being affected by inelastic-demand products and services.
