HSA Catch Up Provision?

If a couple gets a high deductible health plan and the primary member is 54 and spouse is 57. When they open their HSA account can the spouse open it up and get the catch up provision or does the account have to be opened in primary HDHP person's name?

Hope someone has had this situation before.
 
No one can assist me in HSA catch up provision? I am going to guess since it is a family plan and if they open it up as a joint bank account they can qualify for the HSA catch up provision. Does anyone know where I could possibly find out what the rule is? Somarco somebody?

Yes, as long as someone in the couple is 55+, they can take advantage of the catch-up provision. However, when the second spouse finally turns 55, a second "spousal" HSA must be opened.

In short, both catch-up amounts (which are $800 this year & $900 for 2008) cannot be contributed ti the same HSA. However, your couple can put in the catch up amount into the main HSA for now.
