Incarceration = LQE?

Got this from a prospective client. Throwing this out to the Obamacare experts.

I don't qualify for consideration, but I think my husband would. My husband was incarcerated from Dec 9, 2013 until he was released upon completing his sentencing on May 29, 2014. If we purchased insurance in his name for the family, would we qualify for the special election period?

You change where you permanently live, and you gain access to new Covered California health insurance plans. This includes moving to California from another state. This also applies to individuals who are released from jail or prison.

OK, but just the husband only or can the family apply as dependents?

If the husband's release from jail qualifies him for a special enrollment period, and the family has no existing insurance and other family members aren't eligible for qualifying insurance from another source, such as an employer plan, then I think they'd all qualify together.

In most cases you have 60 days from the life event to enroll in new coverage.
