Is it illegal for licensed insurance agents to process cancer screening test?

There's a company that is following this medicare protocol regarding Genomic Cancer Screening. Such as 1. You cannot solicit Medicare Beneficiaries. 2. You cannot approach people on the street. 3. You can not cold call or use a call list. 4. You cannot contact Assisted Living Facilities. 5. You are able to receive referrals from the people that have already been tested, however the referring clients needs to call their friend or family member first, give them your number so they make initial contact. 6. You must have your client sign a SOA before you speak to them about Genetic Screening. They require Background checks and Hippa certifications on all agents. A doctor talks to the client while you are with the client and makes a determination if testing is a "medically necessity" before you swap them.

And they are not a MLM company. Their agents are employees and are paid per hour rather than per swab, per CMS 4-15-19 updated guidelines regarding Anti Kickback regulations.

So How is this still illegal?and prohibited by the Insurance Carriers?

Bahahahaha - so, they think just because they have a loop hole possibility to pay "by the hour" - that it's going to skate through - is crazy.

I feel sorry for any one with a professional License that falls for this . . .

So - one post wonder - who are you and who is this supposedly "compliant company?
 
WHAT MAKES IT ILLEGAL? doesnt the per hour pay comply with the latest CMS payment requirements? If your pay doesnt vary by: 1. the number of individuals reffered, 2. the number of test or procedures performed: or 3. the amount billed or received.
