Is it illegal for licensed insurance agents to process cancer screening test?

So tired of hearing this discussion! It is NOT illegal if it is done properly. PERIOD!!! Our organization has confirmation from 3 different huge attorney groups, one of which are experts in CMS and has confirmed that if the practice is done correctly with HIPAA compliance and other safeguards in place, it is not illegal nor is it a kick-back. The genomic specialist who work for the company we represent are not paid per test nor are they incentivized in any way based on the volume of test's that are submitted. They are paid a salary period. The agent or non-agent is paid for services rendered just as if they sold a Medicare Advantage, Medicare supplement or Medical Device to the senior. After UHC's SCAM email went out, they even changed their position and killed their links that was linked to that email. They confirmed the process that we use is within their guidelines and they in fact will pay for the test provided it qualifies within the mandated required guidelines! They actually plan to start offering the test for $200 for those who don't qualify for $0 with insurance. SO...... Let it go slammers!! If you don't agree with the program that's fine, don't do it. But, stop speaking like you are experts or Guru's on the subject and stop telling agents this is illegal when it is not!!
 
What attorney interpret is no problem means nothing!! CMS will decide what is legal!! Just have to wait till the shit hits the fan and see what they say.

Not a problem, when it's done correctly and referred by the Medicare beneficiaries personal physician who has determined that the test would be beneficial. But when a bunch of agents or other people gather the swabs from random regular Medicare beneficiaries and submit them to a Teledoc who has no relationship with the patient and the agent receives payment for that referral it becomes Medicare Fraud!
Telemedicine is happening! where have you been!
