"Medicare" in Business Name?

Hat are the rules concerning when you can or can't use "Medicare" in your business name? Is it only when it's a B2C business?

There has definitely been an insurance agency in our city that has used the name "The Medicare Insurance Agency" for many years. They answer the phone with one word "Medicare".

As far as I know they have never had an issue. I don't know how unless they are grandfathered in somehow.
 
I met my "Medicare in the name" response quota this week by posting in the exact same post two threads down.

But tell ya what because it's Pre-AEP I'll make an exception.

No, YOU can't use the word Medicare in your business name.
