Over 50 or Under 50?

A client just called because Paychex made them fill out a bunch of forms related to ACA and over 50 ee's.

The client "normally" doesn't have over 50 ee's. Its an ice skating rink. 10 FT ee's. Usually around 30 PT. EXCEPT at Christmas. Between Thanksgiving and New Years, they have about 60 Employees (combined FT and PT)

I'm assuming the 50 EE count is like OSHA, COBRA, FLMA, etc. and its based on an average. But I don't KNOW that and I can't find documentation anywhere.

Any ideas?

He might have to prove that he isn't an Applicable Large Employer (ALE).
