I was notified at the last minute by my employer that if my spouse is eligible for health insurance at her place of employ but chooses not to apply and is covered under my plan they will levy a monthly surcharge of $250 in addition to the family plan coverage I am already paying. Is this legal?

After checking further into this I was notified of the surcharge a couple of weeks after her open enrollment ended which now makes her ineligible for coverage untill next years enrollment which should void the surcharge since it is based on that criteria?
