What's this Estate Recovery Thing?

So I just got a frantic call today from someone who was just about to sign up for the Medicaid plan (she doesn't earn quite enough for the marketplace plans) and she said that she had been notified by the State Dept of Human Services (who administers Medicaid) that for everyone over 55 who enrolls in the new Medicaid health plan, a lien would be placed against their estate and when they pass away the State will move to recover the costs of their health insurance for all the years they were on Medicaid. So this is not really free healthcare those on Medicaid are receiving, it's actually a loan that must be repaid if it can be, in the future. Has anyone heard about this? So houses will have to be sold and bank accounts emptied out etc. I can't believe we haven't heard about this before....
 
The Medicaid Estate Recovery provision has existed for years, but it didn't start making news until Medicaid expansion kicked in on 1/1/2014. Before Medicaid expansion, most people eligible for Medicaid had few assets to recover.

These laws have existed for years. Now that Medicaid doesn't have an asset test, there can be millionaires on Medicaid. If they are over age 55, they should think twice.
