Who Pays Car Insurance in This Case ?

Just curious to know if car A has full coverage and car B hits car A, will the insurance company of car B pay for all damages or only for the deductible leaving the insurance company of car A to pay the rest?

What's it take to get a P&c license in California these days?

The carrier of the liable party is responsible for 100% of the claim.

If the insured that is not at fault files a claim against their own insurance they may be liable for the deductible (most likely) and then their insurance carrier will subrogate the claim with the liable carrier and potentially get the deductible back.

not in nyc! they do some back and forth and say 80% car b 20% car a! and only pay for a portion, then car b goes around and sues you for the 20%

i always tell them 100% or no deal. dont take their money without asking how they are splitting the fault!

not my client, a colleagues' i guess, had a client who got rear ended. got full payment etccc. turns out 3 years later they had a 75% rear ended and 25% rear endee and his own insurance paid the 25% of the other guys damages!

i actually stop solicting for auto quotes lol i have a headache, i tell them i do it as a courtesy if you are already with us. i just wont do auto only (maybe a bad business move?)

Better than North Carolina! We are a contributory negligent state, meaning if you are 1% at-fault (with a few exceptions I believe) then you cannot collect from the other party's insurance.

Wow! So what if someone hits you and causes massive injuries, but you were speeding? You are SOL?

I don't know how those claims work out. I think there is an exception or allowance for speeding of some kind, but don't quote me on it.

You also have to prove it very clearly so if a cop caught you speeding on his radar and a dude t-boned you, that is a lot different than someone saying "you were speeding!"

Speeding can be hard to prove sometimes.

There are other allowances if a minor and things of that nature. It's a whole legal thing that I don't feel like getting into at this time.

But research in NC, there are some unfortunate claims where this has bit people in the ass.

A little biased, of course, but here is something from a law blog relating to it and how some people feel. Didn't feel like googling too much of it here at work while eating lunch.

I like this one a little better, it actually addresses the speeding thing. You have to show the speeding contributed to the accident- if you sped through a green light you still would have had a likely chance of being hit compared to doing the normal limit.

NY is the opposite with no-fault insurance. No matter who is at fault you can claim on your own coverage for up to $50k PLUS you can buy another $25k *after* the accident as long as it's before the first $50k is exhausted.

Isn't that why Allstate pretty much mandated 100k medical payments on every policy? Was that a NY thing or an Allstate thing?
