Agent Produce Agreements

Hello,

I am in the process of starting my independent agency within the next few months. I have searched the form's but couldn't find the what I was looking for, I just found super old forms that told people to PM them and I didn't want to send a PM on a 5-8 year old forums.

I was wondering if anyone would be so kind in helping me out and sharing the agent producer agreements they currently have in place?

Cory, I think you are going to find that most agencies with fairly current agreements, had to sign non-disclosure agreements before membership, precluding them from sharing the agreements.

Maybe you will get some positive responses but many will not be in a position to share this type of information.
 
I'd be really interested in hearing from other agency principals on this matter as well. I'm getting to the point I'm having trouble keeping up, and am talking to a producer about doing a 1099 commission only. They would be working from home, I would provide a generous amount of leads, I would handle the E&O, provide software, and even a company cell phone if they need it. They would just have to use their own computer.

I really need someone to help handle leads that I can't get to, but of course need to be profitable on this.

Since I'm new to this aspect, I'd love to see how you guys handle compensation, vesting and non-compete (if you address these), etc. if you'd be willing to share that with me.
 
Of all things you need to own the computer! If they leave your data may leave with them. Letting them use their own computer and working from home would be a big mistake.
 
dean8287 - that's an illusion of security. What makes you think someone can't copy files & customer data from a computer simply because you own it?

The only chance you have to keep proprietary information under wraps is with an airtight non-compete and employment contract. That said, you may still have to fork over some bucks when it comes time to enforce them.

It is very important to own the computer. When you own the computer you also own the data contained and the work that was done there. How many companies can you think of that have employees use their own computers from home and are given the ability to print and save data from it? There is not really an airtight non compete and it's foolish to think so. These only really work against former agency owners who sell out and then try to steal business back. Anti piracy may be a possibility for an employee. With the computer if needed you can find out everything that was done on it. It can also be shut down and locked remotely by you.
 
In the end its only a piece of paper. I fired a girl a few years ago for theft, she managed to contact and take 4 customers from me but they were family so its to be expected. She did however call on who knows how many more of my customers when she went to work for Farmers. The rates were high she closed no deals and got fired by Farmers also. She then worked at Dunkin Donuts where she was also fired. She had no assets so even if I won a court case for her violating the non-compete what could I get from her.
