Been in an Auto Accident. Claim Question.

So recently I've been in an auto accident. The other drivers swerved into my lane and hit my car. My front tires and front axles are broken and airbags were deployed. Now I know all those can be fixed but I will never feel safe in that car since the airbags were deployed. The other person's insurance company will fix the car but it'll probably cost around $4-5K to fix it when my car is about $3K. So my question is can I tell the insurance company to pay for the car's worth instead of fixing it so I can buy a different car. I'm in MA if that's any help.

** Would I be better off going through a lawyer/ attorney instead of the insurance company?
 
If I understand you correctly, the car is worth less than the cost of repairs. The car will be totaled and if the other party is determined to be at fault, their insurance company will pay you the value of your car.

No need to pay an attorney if the insurance company treats you fair. If they don't, then you get the attorney.

I am agree with that there is no need to spend money on attorney. Talk with the insurance company about this.
