Commercial Insurance Question

Does anyone know what type of commercial insurance would cover an online math tutor (someone who teaches over platforms like Zoom) from someone who sues them for possibly exposing themselves over a camera. Is this General or Professional liabilty or neither? Sorry for an odd first post and question but I am trying to find a market for someone regarding this type of exposure.

Exposure. I get the joke. That type of coverage is available on the BOP and can be increased within the policy. It is no different than coverage for an athletic coach, camp counselor, or teacher in a school system

There's also a pretty big cyber liability there, too. Big. If the Cyber liability is covered on the BOP, it may not be enough, and you may need to get additional policy. I work in commercial only, and this is an issue we're running to with all the new and additional online exposure.

I'm assuming this coverage is for the tutor's employer or agency? Sounds like an EPLI exposure.

He should make every student sign a waiver. They are aware that they will be on the camera when the sign in for the class, so there should be no way of someone possibly trying to make a case out of it.

Yeah, there is still possibility for an issue. What if someone hacks into the meeting and does something inappropriate? I do volunteer work and oversee many online meetings and this is an ongoing issues. There are so many openings for problems, waiver or no.

I believe that will be a problem for whoever is hosting the meeting (Zoom or another platform) I wasn't aware that someone will hack into a virtual meeting and start acting stupid.
I am guessing that if your client speaks with a good attorney and the attorney prepares a special waiver he will be out of a possible lawsuit.
I have seen some very sneaky weavers and contracts.

Oh yeah, there are big time problems with issues like that, and privacy. For our meetings, we actually need a gatekeeper to sit and vet everyone that comes into the meeting. Before we had that, people would come in at random and upload porn.

Right. They can meet with an attorney, and hire them to write the waiver, which will partially protect them. That will cost around $1,000 to $2,000 in attorneys fees.

Or they can consult a competent insurance agent, who will show them were to find a free waiver form online for free, and sell them a $800 policy that will protect them.

I never thought of this. I was in a few zoom meetings but never seen anything crazy.
For attorney services I use Legalshield. Consultation is free, contract review, and advise how to improve the contract/waiver is free and you get a legal defense if someone tries to sue you. You pay some small monthly fee but is a business expense and is a very manageable amount.
