Equita and Releases

New here and in the industry but I seem to be in a pickle, is there anything to be done if a "marketing company" refuses to grant releases even if their Agent Contract states that an immediate release is given upon resignation. Not a release due to cause.

Sorry if this is a known issue or is the industry standard, I just see it as a contract is a contract and I am looking for some guidance as my next step get pretty expensive (lawyer).

We do not know which "side" of Equita they are referring to. If you are on the "final expense/EFES side" then yes Travis would have the expertise. If you are on the MP side of Equita then you definitely need to consult with "WIN".
 
This is actually on the educator market side, reading through some of these posts it seems like this is part of the business sometimes.

I am surprised to find out that different parts of the same company operate differently.
 
Can't imagine wasting time hiring a lawyer, only to spend the six months paying him/her to duke this out with them when you could have just written with another carrier for that time period and then re-contracted.

If they didn't sign an upfront release for you, what would you sue them for?

I assume it would be breach of contract, I have a contract that states an automatic release is given upon termination as long as no money is owed. I also want to find out if the other provisions of the contract remain since the contract was not breached by me.

What is an upfront release? Is that signed at contracting time and the agent holds it until termination time, then sends it to the carrier.
