Forcing an Agent to Submit Claim to His E&O Carrier?

I have a friend who had flood damage to his finished basement due to the back up of his sewer/drains. When it occurred he was notified by his current agent (I am his new agent) that it was covered and to go ahead and call Servepro to have them do the clean up. Later that same day the agent learned that this claim was not covered but failed to call my friend back with this notification.

Flash forward two months and the $4200 bill has not been paid yet. My friend submitted an E&O demand letter requesting that the bill either be paid by his agency or by his E&O carrier. As of today, he has heard nothing from this agency. Is there a way to force this issue? Should a complaint be sent to our state's Department of Insurance? Thoughts?
