can you estimate magi up for rest of the year to avoid
medicaid and be eligible for subsidy?
 
I thought I read somewhere that he can't get a SEP in this example until he exhausts COBRA first. The way I recall it, like HIPAA now, if continuation available, no SEP.
 
Yes, he would get a clawback if He Guesses It wrong. But if his income is low, the clawback is capped at $600. The BASIC plan (that was delayed until 2015) was intended to cushion this effect of people who go back and forth between Medicaid and Low-Income Subsidized Obamacare.

To answer the OP's question, yes you can estimate the MAGI for the rest of the year to see if he is subsidy eligible or Medicaid eligible.
