The question is does the child qualify to be on moms subsidy eligible plan or does the child need to be on dad group plan?

Mom and Dad live in the same house but are not married due to Dad's tax issues. Mom has a plan via HC.gov and Dad has group via work.

Mom's not eligible due to income to qualify for medicaid and has been turned down by CHIP due to the income of both parents in the house.


What would be the proper course here?

Fair response....Long time personal client. However, it's worth learning the right way to handle this for future situations...ya know in 17 the house of cards begins to tumble...

Thoughts on that are the years she claims yes, on her policy. The years no then he needs to have on his policy...yes?

If ObamaCare were fair to families, I'd easily agree with that strategy, TKruger. But, how do you answer the section on the subsidy application where it asks if the husband's job insurance is available and affordable to the child..or even to the Mother for that matter? You didn't mention anything regarding spouse and/or child's eligibility for the husband/father's group insurance at his job.

Child can be eligible in employer group even if parents aren't married. You need to find out about eligibility before being able to advise properly--regardless of custody.

Not worth it, you and I both know it and I just tell clients to call the marketplace on issues like these or any tax question, call your CPA.
