New York Legal Question for Medicare Advantage

Hey everyone,

I'm wondering if anyone knows if it's legal to hire an appointment setter for medicare advantage in NYS? I've got a kid who's hungry but doesn't have his license yet and I'd love to get him on the phone setting appointments for me from my LIS leads. If it's legal, how far can he take it? I know he can't go into specific plans, but can he find out what the client has and speak in generalities?

Cold calling for Medicare Advantage is completely illegal in any state.

That being said, if you have legitimate MA leads (or any other type of leads for that matter) an unlicensed telemarketer can set appointments and collect basic information. "Mrs. Jones what do you currently have?" If they're answering anything more than basic questions ("No, this is different than a Medicare Supplement") then they are starting to cross the line.
 
Thank you! That's the answer I was looking for. I do have legitimate leads, but it sounds like having him setting appointments wouldn't much benefit me. I appreciate it!
