It's simple.

Make the individual purchasers play by the same rule as group purchasers. Apply pre-x to initial purchase only if not covered previously. Once insured, you can switch individual plans and not be subject to underwriting, period.

The "pre-x waiver" thing has always been so bogus and did nothing to help improve the reputation of insurers. (Carriers routinely slapped exclusion riders on pre-x conditions thereby effectively overriding the pre-x clause.)

Not to say my state got something right but this is exactly the situation here in Maine....Pre-X only applies if you have a break in coverage exceeding 90 days (Maine Rule) even with the 90 day break Pre-X is covered after 1 year on the plan.
