Timely Filing For Auto Accident

My wife was involved in an auto accident in 2007. That same year and in 2008, she went to a physical therapist. The physical therapist did not file with either the Auto Insurance Co. nor with our health insurance company. Now the physical therapist is claiming we are personally responsible. I told them that they were provided insurance information and since they did not file, we were not responsible for the total amount. IF the physical therapist now files, it will be denied by the insurance company because it wasn't timely filed. Can the physical therapist come after us because they didn't file with our insurance company?

Normally, in a situation like this the provider will not be able to pursue you personally.

Their error is not your responsibility.

Did the therapist ever send you the bill? They may not be obligated to send it to your insurance company. Did they say they would bill your insurance on your behalf?

Also, did you talk to the insurance company? Did they say they wouldn't pay it? I assume the auto insurance company has this on record already and though they closed the file, they may be able to re-open it, depending on the time lapse since the activity.

It depends on what state you live. No Fault states have specific laws that needs to be followed. I would file a claim and let your insruance carrier decide on how to proceed.
