I've been spending time reading the briefs for this over the last few weeks. I find it interesting that the government is applying one idea of the definition of "By the state" which is currently under scrutiny while in other areas of the ACA they wish for the "By the state" to be defined differently in later parts of the failed policy.

What I also saw as an even larger issue is Government Medicaid benefits are being called into question at the same time.

Specifically Justice Kennedy's follow up on coercion by the government. Pg 16.


It's like a giant ball of spaghetti....you pull one part and it causes the entire thing to destabilize.

The basics of Obamacare run contrary to Mccarran-Ferguson, but no one ever bothers to consider that. Congress and HHS Sebelius have run roughshod over the states and carriers from the beginning and carriers just rolled over and let them. For all intents and purposes Obamacare IS nationalized health insurance.

As it is being currently implemented...I agree. No rules followed...executive orders...change of rules mid stream...:mad:
 
One of the interesting parts of this debate are the reserves held by the carriers. It has to be in the 10's of millions of dollars. If King v Burwellhelps take down the ACA, what becomes of that money? How do they return it or will they be forced to return it at all.
I think in the short time that the ACA has existed, it has done a remarkable job of intertwining itself in a way that will make repeal a difficult, drawn out job that will cause feckless politicians to look to find a way of repealing it without actually repealing it.
 
Reserves aren't interesting at all. It's basically undistributed profit.

When the company closes up, reserves are used to pay any pending claims they are still responsible for. (The only claim policyholders have towards reserves.)

After that, it's part of the funds used to pay outstanding debts.

If anything is left, it's distributed to shareholders.

I am not sure about that. That money was taken to pay claims on coverage that no longer exists. I seriously doubt that a jaded government is going to allow these insurance companies to keep ACA money and give it to their "wealthy 1% shareholders". Not in this day and age. The government is going to want that cash and the former policyholders will want that money back as well. No sir, I think you are "misunderestimating" the claims that will be placed on this cash should King V Burwell go against the Administration.

As for the "carrier bailout money", those funds are committed to pay claims. Any excess, which of course will be nil, is already intermingled in the reserves.
