Am I Really "Independent" at a Captive Agency?

Go captive, visit each of your clients and tell them why you left and rewrite them with better products.
 
the captive agency i worked for was good to me, i was paid on comission, i could do as much or as little work as i wanted to. it was like owning my own business. i loved 90% of it. but the 10% i didnt love is what is making me go independent. you seriously need to go find another place to go. and also about writing your clients over to your new company, read your contract. it probably says you cant touch them for 2 years. so check that out before you do it and get sued. if you have any questions about captive things shoot me an email. id be happy to help
 
Man, the work schedule and dress code as well as the requirement if not in the office you must be on a verified appointment definitely does NOT make you an indpendent contractor. Do they consider you a statutory employee, i.e., they withhold your income tax but do not contribute to your FICA (SS & Medicare)? Do they not withhold your income tax? In that case you should contact the IRS. From what you have stated it certainly sounds as if you are an employee and they should be withholding your income tax AND contributing one-half of your FICA while withholding the other half from your paycheck. It certainly appears that they are abusing you and the Internal Revenue Service.:policeman:
 
I'll take a stab in the dark here that this is more like the new SF contract. I've read a lot about people in a similar situation with shabby commissions and horrible stories about it. Feel free to correct me, of course. I'd resign from the company and cut my losses.

Also, become good friends with an attorney or just marry one. It makes all the difference for me.

Its also sucks because my new manager is the worst manager is history! He's literally the manager from hell. Wait no, he's more like the manager from the hell within hell. He lies, berates, screams and cusses you out if you ask a dumb question, makes mountains out of mole hills and basically everything you can imagine a horrible boss doing, he does. I don't have enough time to list all of the F'd up stuff he's pulled.

Really? I'de have to take the boy outside and explain that his conduct is not appropriate and then politely kick his ass.

Nope, they don't withold anything anymore, I'm 1099. They do deduct all of my "expenses" out of my monthly commissions before I ever see my paycheck, that way their expenses are always paid first. I also thought there were different rules with the IRS for people in insurance, real estate agents etc...to where the companies can call you an Indenpendent contractor but have more authority...But I'm not sure.

You sound like an honest hard working guy who is being taken advantage of.

I'm with warnerins, I think several of us should each take a turn "'explaining" to him that his "conduct is not appropriate". Boy, am I holding back!

I don't know what you are selling but if you want to consider exploring other options I will be happy to share with you all I know about selling Medicare Supplement insurance. I've been doing it for a long time and have a pretty good way of doing it that makes it fairly easy.

I'm sure there are others here that would be willing to share their knowledge about the products they sell.

Thanks all for taking the time to reply! All of your input has been very informative...and gave me a good laugh.

I'd love it so much if they just layed off and realized I'm an IC contractor, I wouldn't even think about leaving. Unfortunately the "tyrant" aka manager has doubled production in his district through intimidation, threats, embarassment etc...so upper management loves him. They don't see the crap he pulls with us, or maybe they do and turn a blind eye. Either way its results that matter to them.

I'm def. going to be looking into my options...if there are any.
