Imagine if you will that the states that don't have their own exchanges are ruled by the supreme courts not to receive subsidies....The ruling is coming in June when again OCare is attempting to be repealed...or at least a major portion of it.

Millions of policies will be dropped

Commissions won't be paid

Lets look at and prepare for the worst case scenario while hoping for the best. What would be your plan of action if this occurred?
 
2/3 majority needed to overrule the Arrogant One's veto, and you can bet he will veto any legislative change.

SCOTUS is a different issue entirely. We can always hope RBG sleeps through the process.

I hear ya, but its not legislative change it's proper application of the "law" So that said we know that the Administration can come in a with executive action regarding this but at what cost?
 
1. We aren't going to see anything significant out of Congress, due to the veto. And the Senate doesn't have 67 votes to overturn an ACA veto.

2. SCOTUS is a total toss up. There is no telling what happens. If it vacates the FFM policies, I would not be surprised if they put something in that says "as of X date". Or if Obama has an Executive Order on his desk, waiting for signature.

From a commissions perspective? I will be happy that I have clients, not customers. 95% of my book are going to have insurance. With or without subsidies.
 
Very important topic to stay up to date on indeed.

Remember, any SCOTUS ruling will not affect consumers/policies for the 2015 year. At earliest the decision affects 2016 moving forward.

Interesting to note that the potential for an executive order always exists in response to a ruling. Historically, the coordinated use of an executive order to a SCOTUS ruling has not been well received. A truly unfathomable ruling ahead for the top 9 legal minds in the country.

If the Supreme Court rules in late June, that would leave about three months until the start of the next sign-up season for coverage.

If the ruling goes against the subsidies, it's unclear whether the courts can delay the effects for more than a few weeks, and most state legislatures are not in session during the summer.
 
Has the Supreme Court ruled against an entitlement program before? I don't think they want to go down in history as the court that caused millions to lose their health insurance. The majority of the Supremes will find a way to keep the status quo...they'll use thousands of words to justify why.

Exactly!

They already had a "justifiable" reason to shoot it down and didn't do it (before anybody had it). I highly doubt they will do it now over some silly wording technicality....now that millions have it.
