I was wondering if anyone knows what legal action can be taken if an agent working for an agency for several years under LOA contracts decides to take their business elsewhere. Can an agent with a captive contract be sued by the agency for writing business with another agency. What if they take their book of business and change their clients into different Med. Supps. or sell the book of business to another agency. Any responses by people with experience with this would be appreciated.
 
Get yourself a good attorney, good advice, and be prepared. Realize this that they can sue you whether they have a case or not.​

Non-compete clause

As stated above check with an Attorney and read your contract. You can also do a google search for your state to get some info. Me I have a Pre-Paid Legal plan for legal questions and document reviews.
 
Read the contract... COMPLETELY!!

I'd venture to say that if your clients started to drop of in droves soon after you leave you're gonna get someone's attention. A contract is a promise and you made one. Break that contract and expect legal and state DOI action. If you want to leave and go on your own... do it without harm to those that most likely trained and supported you in your early carreer.

That said...

There are loop holes in "how" you get your old clients. It may take a year or two, but you can get them. Using a "friend" to channel them or some other method has been used before.
