Apartment Complex Liable?

I have a client who cut her leg on the sharp end of the oven at her apartment. Ended up being a 9" cut requireing 16 stitches. Is the apartment complex liable for the injury?

I'm also unfamiliar with this "sharp end" technology. I think I had a Sharp microwave once, but that was a different situation altogether.


Absent the oven being in some state of disrepair or some other form of obvious negligence, I'm not seeing it. It sucks that it happened, but from a claims perspective this seems more like stubbing your toe, except in this case there was a big gash.

The short answer: Very unlikely.
 
I think it has to do with a lack of sobriety. It sounds to me as if someone was fu&%ed up as a football bat, and took a hard fall!

also... how long had the client lived there prior to this incident? Was she behind on rent at the time of the injury?

To be gashed that wide open, there has to be more to the story.
 
I inspected my oven - couldn't find the sharp end on the outside except for a corner. With that said, a small cut from striking a corner MIGHT be possible - but a 9" cut would require much more action.
 
why would the apartment complex be even considered as liable?

i think the first person i would think of is the "company" that made the microwave, then whoever pushed me lol.
 
I have NO idea how she did it either. Just wanted to be sure on this one. Woke up this morning and realized I had a blonde moment lol
 
I would imagine since the oven was owned and presumably installed by the apartment complex that there is a possibility they could be held liable. I imagine that apartment's company wouldn't pay out unless sued either. Contributory negligence would also have to be looked at for the strength of the case.
 
My impression, wether right or wrong, is this is her fault for not calling maintance to have it fixed.

Second of all, use your health insurance to pay for this. This isnt worth a claim, and how in the hell would this cause a 9" GASH?

Something weird/stupid was going on.

APT shouldnt be held liable for lack of common sense.

I would give odds she is behind on rent or just got laid off and has no money and is trying to win the lottery by a large corporation or insurance company. The APT complex would be stupid to file a claim for something like this and settle before that

I know where the "hot" end of the oven is......I went looking on my stove for the Sharp end....I think I might have found it....I got down on my hands and knees pulled out the draw on the bottom reached in as far as I could and I felt a metal support bar...I think if I pressed down really hard while rubbing said arm back and forth repeatably I could cause injury........

Let me go get liquired up and I'll let you know :)
