I have a small group with BCBS IL that sent me a new employee in April for May 1st effective date. The employee has to use it now. I thought I sent it to my IMO I just realized it was sitting in my draft. Do you think Blue Cross will allow an exception or am I screwed and file an E&O claim

E&O is for real mistakes that require a financial remuneration.

You are an agent for the company, therefore it is perceived as though the company also received it.

Get it submitted then talk to their compliance and/or underwriting division about the situation and get their input.

The main thing is... is was an error and mistake. We don't want the client to suffer or be inconvenienced any more than they already have.

Btw, has the client been paying premiums the entire time? That would be something to check on with the company & payroll, etc.

If no premiums paid, not an issue. Just get them enrolled and premiums will start coming out with the next paycheck.

If it has... make sure that the policy effective date matches when premiums were submitted.

Just going off the top of my head here. Just make it right for the client and you won't have an E&O claim of any kind.
