Guns and Health Care - Interesting

Didn't read the entire article, but I hope they have a better argument then the basic one in the gun case. If interstate commerce has anything to do with money flowing interstate--as from the insured to the insurer--then insurance sounds like interstate commerce, to me.
I think using the gun case is throwing spaghetti on the wall, and hopefully, for insurance salesman, not desperation.

The bill is a large sprawling collection of issues. Not all arguments serve all issues, regardless of whether the arguments are pro or con. Clearly, there are some things that the interstate commerce clause will support. It gets dicey when it is applied to the mandate though. Not saying that one cannot ultimately do a force-fit but there will be some huffing and puffing to get there. It is less clear. However, with 15 states now signed on to challenge it, we shall see..

Obama is arguing that the mandate is esssentially a tax on interstate commerce. Good luck with that. Note, that I am not saying that through more huffing and puffing he cannot come up with a different and "better" argument, but he will not get there without the aforementioned huffing and puffing.
 
How can my lack of doing something be considered commerce... ie buying insurance is definatly commerce but my lack of purchasing something is not commmerce.
 
Yes, I live close to San antonio and I was listening to 1200 am radio out of SA and they did bring this up today. It sounds like it has a chance to make an impact on the Supreme Court decision, possibly.
