Do you ask questions like " you understand this ....insurance..." or something?

Another option is one of those Pulse pens where you can take notes and it records the audio. You can then save the notes to a file with the audio.

Me thinks "if a few" of his clients were pissed off then more then likely he was guilty of something and obviously a judge agreed with me! Fly straight people and you wont have to worry about recording your calls and the cms secret shoppers and using your E&O insurance. I have never had anyone threaten to take me to court ever. Do I know people who have had to use there E&O insurance? You better believe it. And were all those people that had to use their E&O insurance comeplete a-holes? You better believe it!

My bitch about E&O is that it would not cost near as much as it does if we did not have so many slime bag and stupid insurance agents creating claims.

This is a pretty scary topic, especially these days, when everyone is so "hooked up" with attorneys. I saw a website on a billboard like whocanyousue.com. Ridiculous. It really sucks we have been given this sort of name, when indeed, there are many good agents out there. Somepeople just like taking advantage of situations and understand the insurance companies will bow at the knees ESPECIALLY when they here "misrepresented". Sad, sad, sad. Recording is a great idea, never thought of it!
 
I've been told that if you don't discuss every product you have in detail, the client has the right to come back to you at some point (maybe years later) claiming, "you didn't tell me about (that)," is that true?

With annuities, I'm painfully precise, but I'm that way with most insurance products. You can't depend on the carriers to back you up on anything. It doesn't take a tree surgeon to figure that out.

Do you think that he misrepresented the products?

Many months later, she claimed that she had NO IDEA it was life insurance and claimed it was presented as something else. Evidently, some work associates of hers really did get duped by other agents and she wanted to cash in on the situation.

Chumps, this wasn't one of those famous "Retirement Plan for Nurses" cases was it?

People can say and do whatever they'd like. I know of a case where an insured was suing the health insurance carrier for not covering long term care. Apparently her (and her counsel that I was speaking with) were completely unaware of the existence of LTC insurance. Is that something the agent failed to present? Probably, but is it possible to cover the ins and outs of every aspect of the insurance? No. E&O can help you sleep at night knowing that regardless of whether someone has a legitimate claim or not, someone has a financial incentive to protect you from paying out.
