Someone asked me a crazy question.. Animal doctor did a surgery and dog did ok but 2 weeks later died of heart failure due to pnemounia. Client thinks his homeowner's carrier can sue for wrongful death of the animal? any thoughts?

I'm not sure but that sounds like it would be under a professional liability policy if an animal doctor QUALIFIED to do the surgery performed it, and even then only if there is an issue with the performance.

And who exactly is suing? I think I'm misunderstanding...the client thinks that their (the client's) homeowner carrier can sue for wrongful death of the dog to the surgeon? That sounds a little BS and I believe that wrongful death is only for humans, I think animals are mainly considered property.

Or are we saying that they are suing for the fact that the dog got pneumonia from an element of the home since the dog was susceptible from the surgery 2 weeks ago? Even then it sounds like a stretch and the dog would have been taken home against medical advice if that was a concern, pretty much eliminating all liability. I don't think an animal doctor (aka a vet) would just let a dog go who could die 2 weeks after a surgery by being home.

I could be WAYYY out there though, I'm not a legal expert so I am sorta pulling this from outta my ass using prior knowledge from different fields, so take it with a grain of salt...

Why would your clients homeowner carrier be involved? Sounds like it's between the client and the vet and his insurance?? Not sure I fully understand the question/problem?

Yes, the homeowners insurance carrier could sue, but why would they?
Nothing stops anyone from suing someone. It may be a waste of time and money, but they could open the suit if they want. Just don't expect the homeowner to benefit from this at all.

In the rare case this is a serious question, the answer is there is NO COVERAGE for your dog at your vets on your home policy, unless the dog bit someone at the vet and you are being sued, then maybe.

Buy them a new dog?

I don't share the same affection for animals that some people do, but there is a point where you have to just let it go and move on. Nothing they say or do will bring the dog back. Just like people, animals die.

To really put this to the test they could talk to a lawyer and see if they can find one willing to take it on a contingency. Find a competent lawyer that wants that case and then I'll believe they have a good cause of action.

Absent that, get them a new dog.
