Is He Covered?

They guy who ran over the motorcyclist, trying to get away from the other bikers. (You know, the one they have been talking about on FOX for days) Although I'm sure he was probably extremely underinsured, was he covered? I guess the question would be, was this action considered intentional, even though it was to get away from imminent danger?
 
It wouldn't surprise me if it was determined that he is not responsible for the bodily injuries to the biker he ran over. If the biker was ingaged in a criminal act which is what needs to be determined the courts may find that he himself is responsible for his own injuries. if so, I doubt his own carrier would pay (pip)

The Guy in the suv may be able to go after the bikers carrier!
 
The bikers will be filing a claim against him as well.

Most of those bikers have no insurance or even had valid motorcycle licenses.

If you see a lot of these videos, you can see the attacks and intention of their group. 90% sure they will not rule that the suv driver was in the wrong. (but who knows how it will play out)

But how will it play out if 30 bikers filed a claim against him and pursue him in court. (right or wrong) Carriers have to defend him right? It's not unlimited defense is it? If he had 500CSL how many claims will the carrier take on?
 
I handled a similar claim where the driver was intoxicated & seriously injured someone on a motorcycle and coverage is still pending 2 years later.
The carrier will is a ROR while they investigate and coverage will be determined based on the outcome of the criminal action, if pursued. If the insured is found guilty of crime, it's an exclusion and intentional acts is another one.
Either way, the injured biker would not be eligible for MPC or No fault in NY, as the policy excludes coverage for medical bills related to injuries sustained while riding a motorcycle.
The BI limits, if paid, will go right to the unpaid medical bills which will be <1mil. Easy
 
Another aspect of this is if the bikers file against the driver, aren't they telling the police, they were involved in the attack on the Suv? I have a feeling very few if any of these guys will be trying to collect insurance claims on this case.

Not talking down about motorcycle enthusiast, just a few nyc groups who ride in a big batch and split lanes and do wheelies on the highway....

but i see that group once a week or once every two weeks during the summer time.

My brother used to ride with some of those groups, and they dont mind riding with permit only, without licensed bikers around, they ride in big groups and go way over the speed limit... take over roads... and they all turn the license plate upwards or hide them with creative ways. He used to tell me the things they teach you on how to avoid getting to know who you are etc.... I've seen a bunch of friends who are allowed and taught by other friends without license or permit and then let them "borrow" bikes to goto store or friends house etc...

Also the ny police has confiscated alot of those dirt bikers and atvs which are for off road use, but they ride together as well. That group is made up of sports bikes, atvs, and dirt bikers that arent insured/needed to be insured.

Bikes are stolen A LOT here and people buy and sell them easily. They come around with a pick up 2 guys lift your bike up and off they go... Sell it to someone who wants to ride illegally, etc....

Again, i am not talking about all bikers/motorcycle enthusiast, but ever car/motorcycle/motorsports have the bad batch. And i wouldn't say its hard evidence just my opinion.
