New member here so hello everyone!!! :goofy:

Anyways, a bit of background on my claim. I have owned an s2000 for about 2 months. I got it from Copart, already fixed by the seller. Got it good to go, but had it garaged for a long time before i insured it. I finally called my insurance and got it insured full coverage as my other cars but I was told that i can only do that if it's been less than 15days after I got the car. Scared of that, I told the insurance that i got it 2-3 days before that. Deal done, lady told me I am insured. She asked for registration, and plate number. I told her that i dont have it since I just got it and hadnt had time to take it to the dmv (true story)

Now 2 weeks after this happens, some asshat decides to steal my headlights, bumper and lip and cuts my wiring for headlights too. I file a claim blah blah blah. But now i am told by my adjuster that they arent sure if they want to cover me because I can't prove that I had the car repaired before this incident happened.

1- I paid cash to the dealer who got me the car for me from the auction so no receipt there other than the salvage certificate.
2- I printed them pictures of the car as it looked before.

Now they are asking me that they want the pictures dated. Like How the F am I going to date them. I do have the same pictures on my instagram BUT they are from like 7-10 weeks ago before the car was insured. Do you guys think I should show them that or will that be a lie on my side since I had told them that I recently bought the vehicle few days before I insured it?

The damage to the car btw is 5800 :(

Give them the dated pictures. They need to know the car was in one piece previously.

What year is the s2000? How much did you pay for it from CoPart? Did you make the carrier aware that it was a salvage title? Many won't insure a salvage title for comp/collision, which makes me wonder. Some will though.

Really sorry to hear as the S2000 is a nice runaround car. I didn't know about the 15-day "wait period" if that's what it's being called. Did you verify that? Certainly there are people that buy cars, don't insure them right away and are able to get insurance. Good to know though.

Keep in mind that most counties don't have a means to collect small claims cases and it's really hard to collect those judgments. Depending on the case you can put a lien on property or home and they have to pay you upon selling. If it remains unpaid you could turn it over to collections and it will affect their credit, too. Just a couple of things to consider.

If a judgment is made against an insurance company, in almost every case they will issue payment without you having to file any liens or forwarding to collections. I think just a properly written threat of going to small claims court to resolve the matter will make them issue payment in this case. Keep in mind, insurance companies usually do whatever they can to avoid payment. So just because your claim got declined it does not mean that they have some basis for this or some advantage over you. In fact, insurance adjusters are trained on how to avoid paying out claims. Top adjusters are rated on how little they paid out in claims. All you need to do is let them know that 1. You are not a fraudulent claim since you are using the law to resolve the matter 2. Place them in a situation where they will loose money either way on you since litigation costs money. Next thing they will do is try to pay you out for used parts that are worth almost nothing... This will be a bit more challenging but still possible to resolve.
