Medicare Part D Late Enrollment Penalty

I'm trying to help a client who has an LEP because of an alleged late enrollment in Medicare Part D. Just a question:
WHO GETS THE LATE ENROLLMENT PENALTY?
THE INSURANCE COMPANIES ? OR MEDICARE ?
I was told that the insurance companies get it and I need to confirm that because of an article I am writing to be published in the local newspaper.

I'm sure the insurance company doesn't get to keep the LEP. The Ins Co collects the LEP and then probably somehow forwards to Medicare.
