This is the federal study where they used DEI rules as the basis for all this non-discrimination crap . . .
Note that Medigap plans (along with other non-primary payer plans) were considered to be "excepted" and therefore exempt from complying with non-discrimination rules that apply to primary payer coverages.
Here is an interesting treatise discussing excepted coverages.
Excepted benefits generally fall into four categories: (1)
benefits that are generally not health coverage (auto, workers’
compensation, and liability insurance, for example), (2) limitedscope excepted benefits, (3) non-coordinated excepted
benefits, which includes coverage for a specified disease
or illness and hospital indemnity or other fixed indemnity
insurance, and (4) supplemental excepted benefits.
Supplemental excepted benefits also must be provided
under a separate policy, certificate, or contract of insurance.
Medicare supplemental health insurance and coverage
supplemental to TRICARE are specifically exempted by
the regulations, which then go on to exempt “similar
supplemental coverage provided under a group health plan.
It appears that CMS is using doublespeak in an attempt to make an exception for excepted benefits.

And Dems think MAPD is a giveaway to the insurance companies. I think a lot of people forget which administration it was that gave us Part D.

And then they'll complain that more and more people are choosing MAPD. They won't be happy until everybody (except maybe themselves) is on Medicaid from cradle to grave, although they may call it "Medicare."

It’s a crappy law, written poorly.
Proving that drug manufacturers shouldn’t be allowed to write laws…
What don't you like about Part D?
1. The original law had seniors paying 100% in the donut hole
2. The entire concept of deductible-inital-donut hole-catastrophic is ridiculous. Seriously. The average American can’t figure it out.
It’s a poorly written law, with good intentions.
