I have a client that spends 6 months in Fl and 6 months in MI. Does he have a choice on choosing MAPD plans from both states. He currently has an MAPD plan in MI but for 2010 in his area they're not looking very good. He wants to switch and doesn't like the Med supp premiums. Could he look at the FL plans for 2010 also?

No. One of those residences is his primary residence, and that is the state he will have to go with. Now, with Med Supps, he won't have that problem. But the premiums are more expensive.

I beleive it's MI. If he were to call Social Security and say please update my address to the FL address would that be considered a FL resident?

What state does he vote in? He would need to change all of these things to his primary residence. It is just like being in the military. You may be stationed anywhere but you home state is your primary residence. You may spend 11 and half months in the state your stationed in but your home is your primary residence.

Wrong answer, but thanks for playing! It's a 6 month rule. If the persons residence on SS is in Alabama and they stay in Florida 8 months out of the year then it should be a Florida plan. That being said, they'll usually go by the SS and you'd have to prove otherwise (rent agreement, proof of homeownership, etc). If, using the same example, they live in Alabama and visit Floria for 8 month, but stop home to check their mail once a month, then the 6 months restarts. Again, by default Medicare is going to go based off the SS address and you'd have to prove if you lived elsewhere, but those are the rules from the Medicare Advantage world. PM or e-mail me if you need more help than that.
