I am looking to create a social networking website with publicly visible postings from the users. I've spoken to insurance brokers, they all say that their coverage would only work for hiring an attorney if I am a named defendant in a lawsuit. This would leave me undercovered.
If my computer servers are subpoenaed (via a third party subpoena duces tecum from a lawsuit between a plaintiff and a user), I won't be able to protect my business' privacy or my client's privacy. If I get brought into a lawsuit, and later become named, the total claim I would have would be substantial. Is there an insurance company that provides for coverage for subpoena duces tecums wherein the business is not a named defendant? It could stave off future litigation (and minimize my costs and insurance claims). It could also protect my business' trade secrets. I don't want to help a plaintiff against one of my users.
I would like to be able to hire an attorney as soon as I am served with a subpoena --even if the case doesn't name my business. There are things an attorney can do early on.
