Let me clarify something. Even if the uninsured motorist coverage came into play (and I don't see how it does), it would be used to reimburse the health insurance company, making it really a waste of time to go after it.

Either that, I'm missing something big here.

Here is the ploy, was the 16 year old legally able to consent to the 12 year old driving? Of course, then she'd be guilty of theft, right?

You need to find out more about the 12 year old. Does the 12 year old have parents? Do the parents own a car? Do the parents have insurance on the car(s) they own? I believe there is a strong probability of uninsured motorist off of her parents policy. Med Pay may also be available.

You also need to go over the exclusion very carefully in the 16 yr old drivers policy. I have never run across such an exclusion. There are "excluded driver" endorsements where specific drivers are excluded. This does not appear on point in this case. There is also the potential that such an exclusion could be against "public policy" in some states, therefore invalid.

My suggestion is to make a claim under the 16 yo auto policy. They will either pay or send you a nice letter stating why there is no coverage.

You can go from there. If the 12 yo has an available policy via her parents then the letter from the 16 yo's carrier would make her "uninsured" by definition.

Very few health policies have subrogation rights. You would not have to pay the health carrier back for her injuries unless they can prove they have subrogation rights.

Ok, OK, I gave up and called one of my U/W, she said the policy would pay out and this actually happens OFTEN!

For the car, I understand them paying, if coverages are there.
For the injuries to the driver? They wouldn't pay for my injuries if I crashed my own car (except medpay limits). I doubt they would pay for the 12 year old injuries based on the same logic.

Remember, the OP asked if they would pay for the 12 year old's injuries. Never asked if they would cover damage to the car (or whatever was hit).

Yea but you can't be liable to yourself so that is why the BI would not pay your medical or PIP would pay if you caused the accident.
