Not at Fault, Other Insurance Still Not Complient

I guess.... so you are just assuming the guy will never have $750 to pay for his deductible and court fees? It only takes 1 days worth of time. Man if I'm ever unlucky enough to hit a parked car with no insurance I hope its yours.

And what if the OP didnt get UM with a cdw? Should he just bend over and take it?

OP, sad to say that coverages like rental car is something you should have had. Just because something isn't your fault doesn't mean someone else is going to pick up the tab..

I know that this sucks, I've been there. But at the end of the day if you only have 1 car to drive, you should have bought rental.
 
Problem with getting the $750 from small claims is the insurance company will take most of it. You need the full amount, this is why insurance companies deal with this stuff.

If you are out $6000 plus probably another $1000 in other losses, total $7000, and the insurance covered most of it, if you collect $750 from him, it gets prorated between you and the insurance company, based on the portion each of you paid (trust me, seen this happen).

Now, if you let the insurance company handle it, then they will go after the full $7000, and reimburse you for all of your out of pocket expenses, if it is collected.

Raph - He doesn't have to bend over, this is why he has insurance. If the other driver is uninsured, then the CDW will take care of it. Whats so hard to understand about this?

You are assuming he has UM. All I'm saying is if he doesn't, he will end up paying the deductible (also assuming he got a $500 and not $1000). Common dan we are both from Cali and we both know what kind of coverage people tend to gravitate towards. Its a possibility this guy bought minimum liability (I think 20/40/15 for Illinois) with 1000/1000 just so he could drive his car off the lot.

OP even says
"wanted to make sure you guy are paying my deductible and the damages caused by your client to my vehicle and I need a car rental what are the options"

If he had a CDW, he wouldnt have to pay his deductible now would he?

You think people that shop non-standard companies usually buy UM or carry a $250 deductible? I mean it costs a whopping $15 more / month **rolls eyes**. Hes going to come out of pocket because these companies play the waiting game. Eventually hell pay his deductible or pay to get the car fixed and neither one will own up and pay.

My point is if his insurance won't take care of it without him paying a deductible and the other company won't cover it either he should handle it himself. Even if all he gets is his deductible back, he will have been financially indemnified. That's all insurance offers anyway.

I am a licensed insurance agent in Massachusetts and if you don't have rental insurance on your own policy you are able to go through the other parties insurance but they don't need to pay for it. Unfortunately if you don't have the coverage on your own policy you are taking a chance with the rental. But with that being said if you filed a claim through YOUR insurance and have full coverage then you should not have to deal with the other insurance company. Your insurance company should be the one dealing with them. I would contact your insurance company and let them know the other company is giving you a hard time and you are worried and I am sure they will assist you! Good Luck

At this time I last heard from my insurance company a week ago (9/25/12)stated that i am responsible for 1000 deductiblity plus 43$ for a tire replacement total 1043$ deductible... I asked if suppositly the other insurance should pay that ... My insurance stated : We are trying to suborgating against Ameriprise (at fault) to collect back that money and it will be done in one legal swoop. OK SO I figured my insurance will take care of it... It now 9-10 days.. I've been bugging Amerprise to make sure if they are going to pay for it... All I'm getting is an investigation on converage still...
I emailed them back "please eloborate on investigation " and no response on that... I REALLY WANT TO KNOW WHAT INVESTIGSTIOM IS THERE.. This' is what I know who hit my car..

Amerprise is sold by COSTCO so he must have some money to shop there...
He is at retirement age.. 66years.. Maybe he's retired ?!
He Lives in a pretty decent I'd say middle class house ...

I just wondering why this long?
What investigation since sept 6?! One month?!
 
The investigation is normal. Most take 2-3 days, though sometimes they will take months. The carrier won't provide any information to you about the investigation, until it is complete.

90% of the time when they drag out, it is to determine if there is coverage. The person may not have had insurance during the accident. The other times, its they can't get a hold of the insured to get their side of the story, which they want before they write a check.

Take a breath, it takes time, it will get resolved.

Be thankful you have full coverage. Or you would have to go after him yourself. It took me over a year to collect from Rutgers insurance company, in small claims court,over 2500.00 They fought me every step of the way. But it didn't help when i called there lawyer a little slimey wiesel, or when i argued with the judge, when she talking about court rules. (A JUDGE JUDY WANT A BE) at the end of the trial, he brought up some case law, I asked for a copy of it, she said no. and ruled against me. I sued the mother, but her 17 yr daughter was driving and i did not Include the daughter, So i had to refile. When i refiled, i even named the insurance companies claims adjuster. It worked next time around the new judge told him to produce the claims adjuster. 5 minutes later they were writing the check.
