I'm hearing more and more about situations where folks are being enrolled into bogus "ACA" plans by bogus agents/brokers via a company named First Enroll. Has anyone been able to assist clients that have been duped, and successfully enroll them into an ACA plan via a SEP? TIA!

They will probably need to call the Marketplace. If they are actually enrolled in an MP plan, a call center person should be able to open it up for them to select again. If they don't have an actual MP plan, they could possibly have an SEP but it depends on their situation. If they had a plan expire 12/31, you can claim a loss of coverage SEP and see if they require docs.
 
Technically the answer is no on SEP if they bought a non compliant ppaca aca plan. Scam product

But, the marketplace makes there own rules or escalations when calling them.

You may have a valid SEP like loss of compliant coverage

Or if they are in the income range of 100 to 150% Federal Poverty Level you have any sep

Or medicaid if state has it year round if income low.

Or move to new state or live in federal disaster territory
