Premium Free Part A Younger Spouse

Someone turning 65 lacks 40 hours of substantial earnings (only has 24) but spouse, age 60, does have 40+ hours.

Can the T65 spouse use the younger spouses work credits now or does he have to wait until spouse is 65?

I had a client with a similar situation. He was 65 but needed his younger spouse’s credits to get Part B. He had to wait until she was 62. That took about 3 years. So by the time he added Part B, he was 68 years old. Guess what. Medicare penalized him!
That’s right, he’s paying a penalty! That doesn’t sound right and we are currently contesting it. He’s being penalized due to his wife’s age.
