Question About a Divorced Couple

I am writing a home and auto policy for a recently divorced lady. Shes terrified of what her exhusband is doing out on the road and needs to get her own auto policy, which is no problem because he is out of the household. However, I dont know what to do about the home. He still has interest because hes a co owner and on the loan. She wants to know if I can write a policy with out him on it. The divorce papers give her clear use of the house for 2 years, not really sure what that means. What are my options? Thanks.
 
Have you checked the title on the car? You might have the same issue there as well.

On the house, I highly recommend talking with the carrier to see how they want this handled. In general though, you make her the only named insured on the policy, he continues to be an additional insured. She can make policy changes, he can't.

Problem is, he would still be covered in the event of a claim. His stuff gets stolen, he files a claim on her homeowners policy to have it covered. To prevent this, make sure he has a renters policy for whereever it is he is currently living to cover his personal property and liability and make the deductible much lower than the homeowners policy.

The gotcha in this is always what happens in a claims situation. House burns down, who needs to sign what checks? Who gets paid for what? If she is the only named insured, everything goes through her, but you need to make sure he doesn't need to approve anything.

Thank you for your response. The title of the cars are getting transfered. So we're good with that. I did think about adding him as an additional insured. Problem there is, they are requiring a mailing addresss for him. He wont speak to her, she doesnt know where hes been for a year. Its been a tough situation. If I write the policy without him on there am I in violation? Im pretty sure I am, just not sure how else to help her and of course she is a referral and family with my good friend.
 
Violation of what? Just good business practices and maybe a carrier rule somewhere. They won't take your birthday away though.

Goto whitepages.com, search his name, find an address, use it. If its wrong, correct it when you can.
