Rear Ended What Would You Do?

Hey guys, Life agent here. A few days ago my wife and I were behind a line of cars waiting for the first vehicle to turn left.
There was on coming traffic so we had to stop and wait for the vehicle to make its turn.
A guy hits us from behind and sends us up into someone front lawn. We both were wearing our seat belts thankfully.
I was unconscience for a few moments my wife was able to stop our vehicle and call for help.
I was put in a brace and sent by air-evac to the nearest spine trauma hospital.
I have a concussion,whiplash, and and thankfully nothing broken.
For the first few hours I was with out feeling in my left arm.
But now I have full use of it..
I am now at home resting.
What is a fair claim amount for me to ask the other guys insurance company?
I don't want to have to get an attorney, and would prefer to handle this myself.
What would you do?

No need for an attorney. The claim amount should be what damages incurred is (up to policy limits). Your medical bills, loss wages and vehicle, all up to policy limits. Contact your agent though, he needs to advise you on how to proceed.

Honestly, you should receive auto repairs, coverage of property damage to the lawn, medical bills and lost wages. You could add in for pain and suffering, who knows what is fair there. Maybe 10 times lost wages?

I'd just find a local attorney who'd take it on contingency. I'm sure you can find some ambulance chaser to do it for you.
 
I'd wait to see what the carrier comes back with as an offer and go from there. Typically pain and suffering is 3 times medical bills, but there is some play in that. I'd play let's make a deal with the insurance company and if you're not satisfied with the way that works then I'd talk to an attorney.
 
The answer will depend on what state you live in. I wouldn't count on a lot in the pain and suffering department (some, perhaps, a lot, no) unless you have a permanent issue from the accident.

Rules for this vary by state. In some states, your insurance pays for you, other states, you can only get pain and suffering if you have insurance, others depends on the degree of negligence, etc, etc.

Hopefully you are on the road to a full recovery! Also, I hope your wife is fine.

Thanks for the information on this issue. My wife is fine as for as we can tell, just a little sore.
I have a big headache, and lots of soreness.
I am new to the forum and have found it very helpful on this topic, and others.
I read mostly on the life side just wanted to give the PC guys some props.

If you were my brother I'd make sure you get an attorney. Why would you want to deal with extra headaches after such a concussion?
 
I would get an attorney myself. I would also leave my case open or not settle (if that is possible). You never know what kind of effects this could have down the road.
