Road Rage

One of my health insurance clients told me yesterday that her son was attacked in his vehicle by an angry road rager. He was hurt pretty bad and had a lot of medical bills associated with the incident. This happened several months ago.

Isn't this covered under the auto policy, since he was attacked in his car?

I know a few things, but I'm way out of date on how something like this would be handled through a major carrier.
 
Did he file a police report?

ALso, tell him to just call the ins company and ask them. But I guess a police report would help.
 
The health insurance carrier would have subrogation rights against the auto carrier and/or the other person's auto liability. Don't suppose the person who beat him up left contact information.

If they can't find the other person, the health plan would probably go against the auto policy for the Med Pay amount which is usually $5k or so.

Yes, exactly right of course, I've dealt with this business of subrogation in the past, however the circumstances were different, and the victim doesn't have health insurance.

Since he doesn't have any health insurance, I encouraged her to call his auto insurance before it's too late, but I thought the med expense portion of the policy was more than $5K. The case is almost a year old.

The other driver didn't leave a note (cute), but he really hurt this guy and it really pissed me off hearing about it. The man who beat him up was much older, the victim is bearly out of high school. He suffered a concussion and doesn't remember much of the incident.

His mother assumed that it was a younger guy, but from what she told me of the incident, I recognized it as the action of a bitter old redneck. I couldn't argue with her, but my best guess based on what she told me is the guy was 40ish.

$5k is typical. You can get higher limits but I think it maxes out at $10k.

Could be wrong.

Filing a yr old claim is going to be tough, even with a police report if he has one.

Sounds like the kid is just SOL. That's tough.
 
I dont believe this would be covered under an Auto policy, it might be covered under the Homeowners Liability policy.

The vehicle didnt damage the guy, another guy damaged the guy.
 
have him check area business' they might have a camera, that caught the fight. also, if he made a police report.. he might be able to aply for victim compensation. have him check with the county.
