Definitely puts an agent in a tough spot. I was thinking id devise something but it appears that isn't much help or may hurt perception.
I think that it cant hurt if you do it for everyone. But as bobson pointed out you probably need to do it for everyone to avoid any discrimination or bias claims. Your risk of a discrimination claim will probably vary by state... I certainly wouldnt do it for just seniors in california...
Sonic,
If you go back and read the hundreds of pages in the multiple threads we have about the Neasham case. I think there are two really big take aways for us agents.
1. Get a damn good lawyer. His first lawyer was borderline incompetent.
2. When there is a red flag, no matter who raises it, stop everything and investigate.
The bank manager called Glen and expressed concern about the clients boyfriend having worrisome influence over Fran (the client).
At this point he should have met with the bank manager to get a detailed account of why they feel this way and exactly why they are concerned. He also should have met with Fran alone and asked her some very direct questions about the situation with her boyfriend.
He also did not alert the carrier that the bank raised a warning about this transaction.
Instead he told the bank manager that he saw nothing wrong and he went ahead with the sale without notifying Allianz that the bank contacted him with concerns.
A little bit of due diligence goes a long ways.
Then when the son got involved later, he contacted the bank, they contacted the doi/ag. The ag snowballed this into an elder abuse case to help her political career.
If Glenn had informed Allianz of the bank's concerns Allianz would have been in just as much trouble as Glenn. But he didnt do his due diligence... so Allianz had no way of knowing the situation since it was Glenn's job to tell them.
Dont get me wrong. I think Allianz acted like a bunch of rats by not supporting Glenn. But from a corporate standpoint, with as much bad press as they have received over the past decade.... can anyone say that they are surprised???
Do you think the AG didnt want to go after the big bad insurance company if she could have? Allianz got off the hook because Glenn failed to do his job and inform them of critical information about the transaction.
