State Farm Refuses to Pay for Storage - Small Claims Court?

Way too much to comment on so here's the gist.

State Farm will not pay for all the charges.

YOU have the ability to tell them where you want your vehicle towed. Strike one, you didn't tell the police. It matters to no one but you that your wife was hurt. Even if she was taken away in an ambulance it doesn't take more than five seconds to yell to an officer where you want your vehicle towed.

Your vehicle was in storage. Why? Because you couldn't afford to move it. Not anyone's fault, but your own. If you would have the vehicle towed from the storage unit State Farm would have picked up the towing cost and the small storage costs. You did nothing to move it. Strike two.

Strike three is you had Geico. If you would of had a local agent, such as a State Farm Agent/All State, etc, they could have stopped you from incurring the storage charges by explaining the process. You got what you paid for, a call center that did not properly educate you on insurance. $1,000 lesson learned.

Even though you were not at fault for the crash, you are still responsible to mitigate your damages/charges while the other party's insurance investigates the loss. They are liable for storage charges but not excessive charges (4 weeks is excessive). If they had determined there was no coverage, for whatever reason, you still would have been responsible for the charges. You can't just expect someone to pay for it if you aren't proactive enough to try to minimize the costs.
