Insured's property (swimming pool) was affected aftersome heavy rains. The claim was repudiated on the basis of subsidence being anexclusion. My advice to him was that the proximate cause was excessive rains(storm) which is covered under the "insured perils " of the policy.

'excessive rain' is not a covered peril. Could you imagine the property premiums if it were?
 
I sell life only, but I was just curious what happened. I used to have a pool business when I still lived in Louisiana, and some problems with a pool will make your stomach turn. I only did gunite pools, and I heard stories and saw pictures of homeowner's floating pools out of the ground because they didn't take the plug out of the bottom when they drained it for service or cleaning. That is a bad day for the responsible party. My understanding is that the pool is ruined (all the pipes broken and such) when this happens, and it has to be busted out. Thankfully I never had any serious call backs, but there is so much that can go wrong with a pool. Hopefully it is just a liner pool, because I would think whatever the problem is, it would be considerably cheaper to fix.
